  • What is Alakave?
    Alakave is the exclusive circle dedicated to exceptional caves. A sort of Club made up of trustworthy people, who trust each other, and recommend each other. Our members exchange wines from their private collections only between trusted enthusiasts. This site was designed to offer everyone—whether producer or amateur—the opportunity to buy or sell hidden treasures, unsold items, or to unearth an anniversary vintage, as well as any difficult-to-find bottle in outside the private or professional cellars of our members. Explore, chat, click, and have your bottles delivered directly to your home!
  • Why do we need three sponsors to become a member and sell winew?
    To encourage active involvement: Sponsorship is also a responsibility for current members. It is a reciprocal moral commitment that establishes a relationship of trust. On ALAKAVE, sponsors and sponsored can be sanctioned or excluded from our platform in the event of inconvenient behavior. This limits scams, rudeness, lack of transparency, and of course, reassures us all.

    Because it is a great quality and security filter: Our sponsorship system also reinforces a certain selection of our members. Indeed, sponsors, knowing the values and objectives of the site, will tend to sponsor individuals likely to contribute positively to the life of ALAKAVE as well as to the quality of the bottles of wine found there. Our site thus limits the risks of inappropriate behavior, spam or harmful content. This selection at the entrance also makes it possible to preserve a benevolent and respectful atmosphere.
  • Why is there no transport solution on Alakave?
    That's a good question. We hesitated and maybe it will come but for now, we prefer to facilitate the connection, to allow you to get to know each other.

  • How are my financial transactions held?
    We have chosen to use Mangopay payment solutions. MANGOPAY is the payment solution developed by Leetchi for marketplaces like ours. It makes it possible to accept online payments (by card, bank transfer, direct debit, etc.), to reserve funds on behalf of buyers and to automate payment flows. Thus, the seller is only paid when the buyer has received the bottle(s) of wine he has purchased! Obviously this solution costs us a little. This is why for each transaction, ALAKAVE re-invoices you for these service and buyer protection fees.
  • What if the wine I have baught is corked ?
    If the wine seems bland to you and you find aromas of mushrooms and musty, it means that it is corked. A total absence of acidity is also characteristic of a lack of freshness. Or, an unpleasant nutty or cider taste will mean that the wine has undergone too much oxidation during its aging process. And obviously, the wine is no longer good if it tastes like Madeira, a rancid taste.

    It may seem surprising that wine is no exception in terms of consumer rights. It is indeed considered a `product`, so there may be a need for `repair`. The problem is that after opening, it’s quite delicate!

    It is difficult to know if a wine is objectively corked or simply disappointing. Whether you buy wine from a winegrower, a merchant or a restaurant, the behaviour to adopt is a mixture of common sense and diplomacy.

    Without a commercial invoice, the 'legal guarantee for lack of conformity' on which one would rely to return a washing machine to the merchant, is difficult to invoke.

  • Can we find wine professionals - sommeliers, wine merchants or restaurateurs in Alakave?
    Yes, of course it is possible. A professional always needs to make room for the next vintage. He may also, like you and I, want or need to bring some life to his cellar, to sell a wine to afford something else, a vintage he believes in, a grape variety he doesn't have...
    For professionals, distribution is sacred. Under no circumstances will it jeopardize its good commercial relations with its traders or distributors, its producers, or restaurateurs...

    Trusting and comparing is the best thing to do.
    In addition, professionals must imperatively think about including VAT in their selling price. As they are pros, they are of course required to declare it.

    GENERAL CONDITIONS OF SALE (CGV) FOR PROFESSIONAL AND INDIVIDUAL SELLERS ON ALAKAVE
    Version applicable from September 1, 2024
    These general conditions (hereinafter the “General Conditions”) govern the registration of users on the platform, the use of the services offered, as well as the rights and obligations of users.
    They may be supplemented by special conditions for certain services. In the event of a contradiction, the special conditions will prevail over these General Terms and Conditions.

    1. DEFINITIONS
    • Buyer: User (individual or professional) purchasing one or more items on the site. You are either a consumer or a professional within the meaning of Directive 2011/83/EU and the national laws in force.
    • Article: Products offered for sale by sellers, in accordance with national legislation.
    • Additional Conditions of Sale: Specific conditions of a professional seller applying in addition to these General Terms and Conditions.
    • Supplier of the Electronic Wallet: The platform's payment service provider, Stripe Payments Europe, Limited (« SPEL ») ; Stripe Technology Europe, Limited (« Stripe PSP »), approved by the Commission de Surveillance du Secteur Financier of Luxembourg.
    • Service Fees: Fees applied by Alakave for connection, hosting and technical services.
    • User / Seller / Member: Any person registered on the platform to buy or sell items.
    • Sale: Transaction concluded directly between a Buyer and a Seller.

    2. PURPOSE
    These General Terms and Conditions define the terms and conditions for registering users on the Alakave platform, the use of the services offered and the rights and obligations of each party.
    These General Terms and Conditions cancel any prior agreement, offer or document having the same purpose. They may be supplemented by specific conditions for certain services which will prevail in the event of contradiction.

    3. ACCEPTANCE OF THE GENERAL CONDITIONS
    Acceptance of these General Terms and Conditions is mandatory to access the services. This acceptance is materialized by a button at the time of registration.
    Any conditional acceptance will be considered null and void.

    4. PAYMENTS AND DELIVERY
    4.1. Secure payment solution
    Payments made via Alakave are managed by Stripe Payments Europe, Limited (« SPEL ») ; Stripe Technology Europe, Limited (« Stripe PSP »), an approved payment service provider. Users accept the general conditions of use of STRIPE.
    4.2. Delivery
    ALAKAVE.COM does not offer a delivery solution integrated into the platform which is limited, to date, to establishing contact and submitting an ad.  On the other hand, the site reserves the right to recommend trusted transport solutions, which are managed by logistics partners without any constitutive relationship with Alakave.com. Each partner applies its own CGV/CGU.  By using these services, the user also accepts the T&Cs of these partners. Alakave does not charge additional fees for using delivery services.

    6. FORCE MAJEURE
    In the event of force majeure, the performance of the obligations of Alakave or the seller may be suspended. A force majeure event is defined as an unforeseeable, irresistible event beyond the control of the parties, making it impossible to perform the contract.

    7. RESPONSIBILITY
    7.1. Alakave as an intermediary
    Alakave acts as an intermediary between buyers and sellers. It is not responsible for the acts or omissions of sellers, nor for the quality or conformity of the items.
    However, Alakave reserves the right to intervene in the event of a dispute reported by a user, in particular for violations of these General Terms and Conditions.
    7.2. Tax obligations
    Users (individuals or professionals) are solely responsible for their tax and social obligations arising from their activities on the platform.

    8. PROTECTION OF PERSONAL DATA

    In accordance with the GDPR, Alakave and the sellers share responsibility for the processing of personal data. Each party must respect the obligations provided for by the regulations.

    9. MODIFICATIONS TO THE T&Cs

    Alakave reserves the right to modify these General Terms and Conditions. Users will be informed of changes by email and via a notification on the platform.
    The modified terms will only apply to transactions entered into after those modifications come into force.

    10. DISPUTE RESOLUTION

    In the event of a dispute between a user and Alakave, you can resort to consumer mediation, in accordance with the provisions of the Consumer Code.

    11. APPLICABLE LAW
    These General Terms and Conditions are governed by French law. In the event of disagreement, users can refer to the dispute resolution procedures put in place by the platform.
